These Terms of Service ("Terms") govern your access to and use of the website and services provided by Grow Media Group, LLC dba Grow Media ROI ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.
We provide professional digital advertising strategy, management, creative development, landing page optimization, and related consulting services for location-based businesses. All services are provided on a professional best-efforts basis.
Important: We do not guarantee specific results, return on ad spend (ROAS), lead volume, conversion rates, ad placements, or advertising performance. Advertising outcomes depend on many factors outside our control, including but not limited to your offer, creative quality, budget, competition, platform policies, market conditions, and seasonality. Any projections or case studies are illustrative only.
You are responsible for providing accurate information, timely feedback, and necessary access to ad accounts, websites, and analytics. You represent that you have the legal right to advertise the products/services described and that your materials comply with all applicable laws and platform policies.
Fees for services will be outlined in a separate proposal or agreement. Payment terms are typically net 15 or as otherwise agreed. Late payments may result in suspension of services.
Upon full payment, you receive a non-exclusive license to use deliverables created specifically for you. We retain all rights to our methodologies, templates, frameworks, and pre-existing intellectual property.
To the maximum extent permitted by law, our total liability arising out of or related to these Terms or our services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business opportunities.
Either party may terminate services as outlined in the applicable service agreement. Upon termination, you remain responsible for payment of services rendered.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Denver, Colorado.
Grow Media ROI is an independent digital advertising agency. We are not affiliated with, endorsed by, or sponsored by Google LLC, Meta Platforms, Inc., Microsoft Corporation, or any other advertising platform.
These Terms, together with any service agreement or proposal, constitute the entire agreement between you and us regarding the subject matter herein and supersede all prior agreements.
